In this "slam dunk" case against Mark it's curious as to why Bill Clayton, the prosecutor, refused to produce the DNA "evidence"  time after time as ordered by the court.  After all, County Attorney Andrew Thomas stated that "we've crossed our t's and dotted our i's."

Here is the time line and the games that the state played in an effort to not hand over the so-called DNA evidence.

10/26/06:  Judge Keppel asks why DNA evidence has not been produced and orders Clayton to produce the DNA CD to defense in two weeks. Due date 11/13/06.

11/17/06:   Mark's attorney, Corwin Townsend, learns that state now will not produce the DNA CD until Dec 1.

12/1/06:   Clayton misses the 12/1 date to produce DNA evidence.  Clayton does provide hard copies but Corwin is told by Mark's DNA expert that it is STILL NOT what she needs.

12/4/06:  State finally produce a CD.

12/21/06:  Today Mr. Townsend learns from Mark's DNA expert that the DNA CD that Clayton handed over IS STILL NOT what she needs. DNA expert remarks to Mr. Townsend that she has never seen anything like this before (she's been doing this for 20 years) and remarks she has never seen anything like this before (referring to prosecutor's behavior and reluctance to produce DNA evidence).

12/26/06:  Judge’s motion is that the state must produce all evidence by this Thursday, 12/28, 5:00 pm

12/28/06:  State misses deadline.

12/29/06:  State produces DNA CD.

Two crime labs (City of Phoenix and DPS) both tested the crime scene swabs and they are not even in agreement on the analysis.  In fact, one crime lab says that nothing conclusive can even be derived from the degraded DNA crime scene samples.   There was never a database "hit" as so widely reported by City officials and representatives.
